Purpose and Reason:

The Department is filing these rules pursuant to RIGL 42-35-3(b) as emergency regulations to cover the 20-day effective period after the adoption and filing of the Amended Rules and Regulations for Licensing of Behavioral Healthcare Organizations. These emergency regulations are identical to the Amended Behavioral Healthcare Regulations adopted and filed on April 19, 2010, effective May 8, 2010. These Emergency regulations create a Behavioral Health Acute Stabilization Unit as a hospital diversion unit and step down for Rhode Island residents, 18 years of age or older who are experiencing psychiatric and/or substance abuse related crisis. The unit will provide ongoing assessment and observation, crisis intervention and psychiatric, substance and co-occurring treatment.

This emergency filing is to cover the 20-day effective period, while the Amended Behavioral Healthcare Regulation go into effect.
